KSK Terms and Conditions


I. GENERAL PROVISIONS

  1. The loyalty program is run under the name "Key Customer Club" on Militaria.pl or "KSK"
  2. The organizer is FHTM sp.z o.o., entered into the register of entrepreneurs kept by the District Court for Wrocław Fabryczna in Wrocław, VI Commercial Division of the National Court Register under the number KRS: 0001007605, NIP: 8971750736, REGON: 020921807, place of business and address for service: ul. Oławska 16, 50-123 Wrocław, e-mail: kontakt@militaria.pl, tel. +48 71 347 47 00.
  3. The organizer is promising an award within the meaning of Art. 919 of the Civil Code.
  4. These Regulations define the rules, scope, conditions for the organization and participation in the Key Customer Club specified by the Organizer.
  5. The Regulations are the only document specifying the rules, scope, conditions for the organization and participation in the Key Customer Club.
  6. The Regulations are available on the Store's website www.militaria.pl.
  7. In matters not covered by these Regulations, the provisions shall apply:

    2. Act on the provision of electronic services of July 18, 2002. (Dz. U. Nr 144, poz. 1204 ze zm.),
    3. Consumer Rights Act of May 30, 2014. (Dz. U. 2014 poz. 827),
    4. The Civil Code Act of April 23, 1964. (Dz. U. nr 16, poz. 93 ze zm.) and other relevant provisions of Polish law.

II. DEFINITIONS FOR THESE TERMS AND CONDITIONS

  1. WORKING DAY - one day from Monday to Friday, excluding public holidays.
  2. REGISTRATION FORM - a form available on the website www.militaria.pl that allows you to create an Account.
  3. ORDER FORM - a form available on the website www.militaria.pl that allows you to place an Order.
  4. CUSTOMER - a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
  5. ACCOUNT - marked with an individual name (login) and password, a collection of resources in the Organizer's ICT system, in which the Participant's data is collected, including information on awarded Points.
  6. KSK - Loyalty program Key Customer Club.
  7. ORGANIZER – FHTM sp. z o.o., ul. Oławska 16, 50-123 Wrocław, NIP: 8971750736, REGON: 020921807, KRS: 0001007605.
  8. REWARD POINTS - units of account in the KSK granted to Participants in accordance with the provisions of the Regulations under the Sales Agreement or other activities specified in Chapter V.
  9. REWARD - a discount granted to the Participant in exchange for Points spent during the purchase.

  12. STORE - the Organizer's online store operating at www.militaria.pl
  13. OPINION SYSTEM - an electronic service made available to Customers by the Service Provider, enabling the posting of opinions regarding the course and implementation of the transaction.
  14. MEMBER - a natural person with full legal capacity who intends to join or joined the KSK in accordance with the provisions of the Regulations.

III. JOINING THE KEY CUSTOMER CLUB (KSK)

  1. Joining and participating in the KSK is voluntary and free of charge.
  2. In order to join the KSK, you must register an Account via the Registration Form.
  3. In the Registration Form, please provide your e-mail address and set a password for the Account.
  4. An activation link will be sent to the e-mail address provided in the Registration Form, which must be clicked to activate the Account.
  5. You can log in to the Account using the password and login (e-mail address) provided in the Registration Form after activating the account.
  6. Profile holders on Facebook.com or Google.com can create an Account using those profiles.

IV. PERSONAL DATA

  1. Personal Data necessary to be a Member of KSK:
    1. E-mail address
  2. The Organizer is the administrator of personal data.
  3. Members' personal data obtained in connection with the organization and running of the Key Customer Club will be processed for purposes related to the organization and handling of the Participant's participation in the KSK.
  4. Members' personal data will be processed in accordance with the principles described in the Privacy Policy and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and the repeal of Directive 95/46 / EC (GDPR).

V. REWARD POINTS AT KSK

  1. Member receives reward point for:
    1. Shopping in the Store - 1 point for each full PLN 10 of the order value, excluding delivery costs,
    2. Valuable Opinions about products posted in the Store - 5 points,
    3. Other activities that are the subject of incidental promotional campaigns, the detailed terms and conditions of which and the number of points awarded are specified in the regulations dedicated to them.
  2. The Reward is a discount of 50 gr for each Reward Point used when placing an order in the Store.
  3. The Member may use Points at any time not later than the end of the year in which they were awarded. Unused Points are removed.
  4. When calculating the amount of Points necessary to cover the value of the Order, the value of the order is rounded up to 50 gr.
  5. Reward, the discount, is limited by the rank of account:
    1. Base max 15% of the order value,
    2. Silver max 20% of the order value,
    3. Gold max 25% of the order value,
    4. Platinum max 30% of the order value.
  6. Shipping costs are not included in the discount for Reward Points.
  7. Reward Points cannot be exchanged for a cash equivalent.
  8. Reward Points may be used or earned if the Member:
    1. is logged in to the Account when taking actions in the Store specified in V.1.,
  9. If the Member returns a product for the purchase of which he received Reward Points, these Reward Points will be deducted from the Account.
  10. If the Member returns a product for the purchase of which he used the Reward Points, these Reward Points will be returned to the Account.
  11. The Member's Account is assigned to a specific Rank for 90 days.
  12. Assignment to the Rank is based on the number of points obtained by the Member for purchases within the last 90 days:
    1. Base – basic rank,
    2. Silver - 80 points,
    3. Gold – 160 points,
    4. Platinum - 320 points,

VI. RETURNS WITH NO TIME LIMIT

  1. The Member has the right to return the goods after 30 days from the date of purchase.
  2. In order to make a return, the Member should complete the return form, which is available in the order history on the KSK account, and then send the goods to the Organizer in accordance with the option selected in the form.
  3. The Member is responsible for reducing the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
  4. Subject to points 5 and 6 of this chapter, the Organizer will refund all payments made by the Member related to the purchase of goods, which the Member returns, using the same method of payment as used by the Member, unless the Member has expressly agreed to a different method of return that does not include extra cost.
  5. If the Member chose a Product delivery method other than the cheapest standard delivery method offered by the Store, the Organizer is not obliged to reimburse the Member for additional costs incurred by him/her.
  6. The Seller may withhold the reimbursement of payments received from the Consumer until receipt of the items back.
  7. The Member is not entitled to a refund after 30 days from the date of purchase in the event of:
    1. non-prefabricated items, manufactured according to the Member's specifications or serving to satisfy his individual needs,
    2. items delivered in a sealed package,
    3. food,
    4. things that after delivery, due to their nature, are inextricably linked with other things,
    5. sound or visual recordings or computer programs delivered in a sealed package, if the package has been opened after delivery,
    6. books, journals, periodicals or magazines,
    7. digital content that is not recorded on a tangible medium,
    8. batteries and accumulators,
    9. products with an expiry date, that is:
      - pepper spray,
      - oils and greases,
      - remedies for insects,
      - środki do dezynfekcji,
      - water treatment tablets,
      - impregnants,
      - drug tests,
    10. water filters,
    11. anti-smog masks, hygienic masks and filters for them,
    12. protective/shooting glasses and goggles,
    13. other personal protective equipment (e.g. ASG protective masks),
    14. blast cartridges, caps, flares and other pyrotechnic materials.

    VII. COMPLAINTS

    1. Complaints related to the Key Customer Club may be submitted by the Member via e-mail to the following address: zapytania@militaria.pl or in writing to the following address: ul. Oławska 16, 50-123 Wrocław
    2. In the above e-mail, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of occurrence of the irregularity and contact details. The information provided will significantly facilitate and accelerate the complaint handling by the Organizer.
    3. Consideration of the complaint by the Organizer takes place immediately, not later than within 14 days.
    4. The Organiser's response to the complaint is sent to the Member's e-mail address provided in the complaint or in another way provided by the Member.

    VIII. FINAL PROVISIONS

    1. The Regulations are available at the Organiser's office and on the website www.militaria.pl
    2. The Regulations are the only document specifying the rules of the Key Customer Club, all promotional and advertising materials are for information purposes only.
    3. The Organizer's Key Customer Club is coordinated by Promotion and Marketing Department, which can be contacted at the e-mail address: zapytania@militaria.pl
    4. Any disputes arising from participation in the KSK, between the Organizer and the Member, will be settled first by negotiation, with the intention of an amicable settlement of the dispute. However, if this would not be possible or would be unsatisfactory for either party, disputes will be settled by a competent common court, in accordance with point 5 of this chapter.
    5. Court settlement of disputes:
      1. Any disputes arising between the Organizer and the Member (Customer) who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of November 17, 1964. (Dz. U. Nr 43, poz. 296 ze zm.).
      2. Any disputes arising between the Organizer and the Member (Customer) who is not also a Consumer shall be submitted to the court having jurisdiction over the Organiser's seat.
    6. The Organizer reserves the right to change the Regulations, about which the Member will be informed each time.
    7. Amendments made to the KSK Regulations shall be binding on the Member, provided that he has been properly informed about these changes and has not terminated his participation in the KSK within 14 days from the date of notification of the changes introduced by the Organizer.
    8. Information about the change in the regulations will be posted on the website www.militaria.pl and/or sent by e-mail to the Members to the address provided by them in the Key Customer Club.
    9. These terms and conditions are valid from March 14th 2022.
