Terms and conditions for returns of products purchased in stationary stores

I. General provisions

1. These terms & conditions (hereinafter referred to as the "Terms & Conditions") specify the rules for returning Products purchased in Militaria.pl's Stationary Stores located in Poland.
2. The customer has the right, but not the obligation, to use the return policy covered by these Terms & Conditions, as well as all rights that he is entitled to under these Terms & Conditions.
3. Each customer will have the opportunity to read the content of these Terms & Conditions in all Militaria.pl Stationary Stores, as well as on the Internet at www.militaria.pl.
4. These Terms & Conditions are valid from 15/05/2016 until the date of public disclosure (in accordance with point V section 4) of information about the cancellation of the following rules for returning Products.
5. The rules described in these Terms & Conditions do not prevent the Customer who is a consumer from pursuing claims under the Act on Consumer Rights.

II. Definitions

The terms used in these Terms & Conditions mean:

1. „Organizer” – FHTM sp.z o.o., entered into the Register of Entrepreneurs kept by the District Court for Wrocław Fabryczna in Wrocław, 6th Commercial Division of the National Court Register under KRS number: 0001007605, tax identification number NIP: 8971750736, statistical number REGON: 020921807, place of business and address for service: ul. Oławska 16, 50-123 Wrocław, e-mail address (e-mail): zapytania@militaria.pl, tel. +48 71 347 47 00.
2. „Products” - products that are in the current offer of a particular Militaria.pl Stationary Shop.
3. „Stationary Store” - a showroom located in Poland where the goods are sold and which is listed in point VI. of these Terms & Conditions.
4. „Customer” – an adult natural person (or a natural person who is over 13 years of age with the consent of parents or guardians, unless such consent is not necessary in the light of applicable regulations) or a legal person who accepts these Terms & Condition and the rules for returning the Products set out therein, and is a person who buys the Products at the Militaria.pl Stationary Store.

III. Conditions and deadline for returning the Products

1. Each Customer has the right to return the Products purchased in the Militaria.pl Stationary Store within thirty days from the date of its purchase (i.e. from the date disclosed on the receipt or VAT invoice as the date of sale) without giving a reason.
2. Before purchasing the Products, the Customer should make sure that the Products he intends to purchase are subject to return under these Terms & Condition.
3. Only the Products that meet all of the following conditions are subject to return:
   1. is fully functional and complete,
   2. does not bear traces of use resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the item,
   3. does not belong to the group of assortments referred to in paragraph 5.
4. Products which price, due to physical defects, damage, incomplete value, has already been covered by promotions, reductions, discounts, discounts or other special price offers, is not refundable under these Terms & Conditions. No other return rules indicated in separate promotional campaigns are subject to connection with these Terms & Conditions. In case of doubts as to the fact of including certain Products in promotions, reductions, rebates, discounts or other special price offers, the information of the manager of the Militaria.pl Stationary Stores or a person authorized by him/her is decisive.
5. Products from the following assortment groups are not subject to return:
   1. underwear,
   2. headgear,
   3. batteries,
   4. containers with gases, liquids or lubricants, substances or products (loose and bulk), the condition of the packaging (pins, seals, blister) does not allow to determine the integrity of the contents,
   5. packaging of airsoft and paintball balls and packets of pellets, the condition of which the packaging (cotter pins, seals, blister) does not allow to determine the integrity of the content,
   6. electronic devices that require registration and logging in for proper operation, after these activities (e.g. mobile phones, gps navigation) or calibration (e.g. breathalysers),
   7. products ordered at the customer's request, which are prepaid in full at the Militaria.pl Stationary Stores.

   As well as Products:

   1. perishable or with a short shelf life,
   2. delivered / purchased in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery,
   3. which after delivery / purchase, due to their nature, are inseparably connected with other things,
   4. sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery / purchase,
   5. books, journals, periodicals or magazines.
6. The return of the Products that meet the conditions set out in sections 3-5 above may be made only on the basis of the original document of purchase of the Goods at the Militaria.pl Salon, where the purchase was made. The refund can only be made on the basis of a fiscal receipt with a sales specification or a VAT invoice.

IV. The mode of returning Products

1. The Customer who intends to use the possibility of returning the purchased Products should go personally to the Stationary Store in which he/she made the purchase, show and deliver to the seller the original fiscal receipt or VAT invoice that was issued to him at the time of purchase of the returned Products, as well as give the seller Products that meet the requirements described in point III sec. 3-5 of these Terms & Conditions.
2. If Organizer recognizes that a given situation qualifies for the return of the Products in accordance with these Terms & Conditions, the Organizer will collect the Products from the Customer, as well as the receipt or VAT invoice issued to the Customer at the time of purchase, and then return the amount paid to the Customer in the amount of the price shown on the original sales document. The refund of the price paid by the Customer at the time of purchase takes place only on the same terms as the Customer made the payment at the time of purchase of the Products. This means that if the payment is made by means of a payment card, the refund of the sale price takes place only and exclusively to the Customer's account using the same payment card (i.e. the same one with which he/she made the purchase), and if the payment is made in cash, the customer receives a cash refund.
3. Cash collection for the returned Products must be made on the day of returning the Products.
4. The Customer is obliged to confirm the fact of returning the Products and collecting cash with his own signature and date on the relevant documents.
5. In disputable cases requiring individual consideration, the decision to accept or refuse to accept the return of the Products from the Customer is made by the Manager of the Stationary Store or a person authorized by him/her. In a situation where the Customer does not agree with the decision of the Manager (or a person authorized by him/her), he/she has the right to file a complaint in this regard. Such complaints should be sent in writing to the Organizer's address within 3 days from the date of receipt of the decision of the Manager or a person authorized by him/her to consider the legitimacy of the complaint or request.
6. Failure by the Customer to report the intention to return the Products on the terms described in these Terms & Conditions within thirty days from the date of its purchase means resignation from the Customer's rights under these Terms & Conditions. In such a situation, upon the expiry of the period referred to in the preceding sentence, the Customer finally loses the possibility to exercise his rights under these Regulations in relation to the Goods for which the period in question has expired.

V. Final Provisions

1. The Organizer reserves the right to cancel or shorten the period of validity of the rules for returning Products set out in these Terms & Conditions without giving reasons, by placing a written information at Stationery Stores or on the Internet on the www.militaria.pl website.
2. The Organizer is not obliged to cover any costs incurred by the Customer in connection with the return of the Products.
3. The Organizer is not responsible for any disputes arising for reasons attributable to third parties.
4. The Organizer reserves the right to make changes to the Terms & Conditions, in particular to increase or decrease the number of Stationary Stores covered by its provisions, as well as to change its rules. The change comes into force from the date of placing the relevant written information in Stationary Stores or on the Internet on the www.militaria.pl website.
5. Any disputes arising from the application of the provisions of these Terms & Conditions will be settled by the court competent for the seat of the Organizer, unless the mandatory provisions of law provide otherwise.
